BeatLab — Terms of Service

These Terms of Service ("Terms") govern your use of the BeatLab web application (the "Service"), available at beatlab.online. Please read Section 2 carefully — it explains that once you get access, you give up the normal 14-day right to cancel.


1. Who you are contracting with

1.1 The Service. BeatLab is provided by AcuteLabs, a Dutch sole proprietorship (eenmanszaak — the Dutch legal form for a one-person business; it has no separate legal personality from its owner) operated by Dennis Sagel, registered with the Dutch Chamber of Commerce (KvK) under number 42058852, where AcuteLabs is a registered trade name of Gezondheidszorg, Wetenschap en Verpleegkunde, registered business address Aalscholver 17, 9728 XK Groningen, the Netherlands, contact hello@acutelabs.nl ("AcuteLabs", "we", "us"). These Terms are the contract between you and AcuteLabs about using the Service.

1.2 Your purchase is a separate contract. When you pay for BeatLab, you are buying from Lemon Squeezy acting as Merchant of Record ("MoR") — currently trading as Lemon Squeezy, part of Stripe (Lemon Squeezy was acquired by Stripe in 2024; the exact contracting entity is named on your purchase receipt and in the buyer terms linked from the checkout page). "Merchant of Record" means Lemon Squeezy — not AcuteLabs — is the legal seller of your subscription. In practice that means:

1.3 Two sets of terms apply. Your purchase transaction is additionally governed by Lemon Squeezy's own Buyer Terms & Conditions and refund process, published at lemonsqueezy.com and linked from the checkout page you used. Where those terms and these Terms conflict on payment, invoicing, tax or refund/chargeback matters, Lemon Squeezy's terms apply; on everything about using the Service — your license, permitted use, content and liability — these Terms apply.


2. Your 14-day right to cancel

2.1 The statutory right. If you are a consumer in the European Union (or another jurisdiction with an equivalent rule), you normally have the right to withdraw from an online purchase within 14 days, without giving a reason (Article 9, EU Directive 2011/83/EU on consumer rights; under Dutch law: Article 6:230o of the Dutch Civil Code, Burgerlijk Wetboek).

2.2 The digital-content exception. BeatLab is digital content that is not delivered on a physical medium — there is no CD and nothing is shipped; it is a web application you get access to immediately. EU law allows a trader to switch the 14-day right off for exactly that kind of product (Article 16(m) of Directive 2011/83/EU; in Dutch law Article 6:230p BW), but only if you have actively agreed, before access begins, to start immediately and have acknowledged that doing so ends your right of withdrawal.

2.3 How your consent is recorded. At checkout — operated by Lemon Squeezy — you accept Lemon Squeezy's Buyer Terms before paying. Those terms contain the express statement that, for digital content made available immediately, you consent to immediate performance and acknowledge that you lose your right of withdrawal once access begins.

2.4 You keep 14 days either way. Whether or not the exception in 2.2 applies to your purchase, we will refund you in full, on request, within 14 days of purchase. No deduction of any kind, and you do not have to give a reason. This is our own commitment on top of whatever statutory rights you have, and we make it deliberately: we would rather you got your money back than felt stuck with something that was not what you expected.


3. Refunds, renewal and cancellation

3.1 How to ask. Email hello@acutelabs.nl, or use the "Manage order" link in your Lemon Squeezy purchase confirmation. Because Lemon Squeezy processed your payment, the refund itself is issued by them; we never held your money.

3.2 Our refund policy. Within 14 days of purchase: a full refund on request, with no deduction and no reason required. After 14 days: we look at each request on its own merits — write to us and tell us what happened.

3.3 Effect of a refund. If a refund is issued, your BeatLab licence is revoked and your access ends.

3.4 Lemon Squeezy may refund independently. Lemon Squeezy is the merchant of record for your purchase. They may issue a refund within 60 days of the transaction on their own initiative, for example to resolve a payment dispute, whether or not we are involved.

3.5 Renewal. BeatLab is a subscription. Your licence runs for one year for €29 and renews automatically for a further year unless you cancel. We will tell you by email before a renewal is charged, and we will tell you in advance if the price changes.

3.6 Cancelling. You can cancel at any time through the "Manage subscription" link in your purchase confirmation, or by emailing us. After the first year you may cancel at any moment with a notice period of no more than one month — this is your right under Dutch law (Article 6:236 sub j of the Dutch Civil Code, the Wet Van Dam), and nothing in these Terms limits it.

3.7 What happens when you cancel. Cancelling stops future charges. Your access continues until the end of the period you have already paid for, and then ends. We do not refund the unused part of a period that is already running, except under 3.2.


4. What you get, availability, and what happens if the Service changes

4.1 What's included. Your license gives you access, for the License Period, to the BeatLab web application: its interactive ECG training modules, usable in any modern browser with nothing to install, for one named user (see Section 5.2).

4.2 Availability. We aim to keep BeatLab available and working, but we do not promise uninterrupted access or a specific uptime percentage. We may carry out maintenance, and may add, change or remove features as the Service develops. We will not reduce the core training content you paid for to something materially worse during an active License Period without good reason.

4.3 If we discontinue the Service. If we ever discontinue BeatLab entirely, we will refund the unused part of your current licence period on a pro-rata basis, and we will give you at least 30 days' notice by email so you can finish what you were working on.


5. Your license to use BeatLab, and what you may not do

5.1 License grant. Subject to these Terms and payment, AcuteLabs grants you a personal, non-exclusive, non-transferable license to use the Service during your License Period, for your own professional education and training.

5.2 One license, one person. A BeatLab license is for a single named individual. You log in with your email address and a one-time code sent by email; you may not share your login or license with anyone else, including colleagues, even within the same organisation.

5.3 Not allowed. You may not:

5.4 Ownership. The Service — including its software, simulations, 3D models, training content and course material — is and remains the property of AcuteLabs or its licensors. These Terms give you a right to use the Service; they do not transfer ownership of anything to you.


6. What BeatLab is — and what it is not

6.1 BeatLab is an educational training tool for clinicians, paramedics, nurses, physicians and students. It is not a medical device, is not intended for diagnosis or clinical decision-making, and must never be used to make decisions about the care of a real patient.

6.2 ECG content. All ECGs shown in the four modules sold as BeatLab are generated by a simulator built from physiology. No real patient recordings are used. (Verified on the live server, 13 August 2026: zero references to the PTB-XL dataset in any of the four modules.)


7. Liability

7.1 To the maximum extent permitted by law, AcuteLabs is not liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Service.

7.2 Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including (without limitation) liability for intent or gross negligence (opzet of bewuste roekeloosheid) on AcuteLabs' part, liability for death or personal injury caused by our negligence, and any statutory rights you have as a consumer under Dutch or EU law that cannot be waived by contract — including your right to a remedy (repair, price reduction or termination) if the digital content does not conform to the contract, under the EU Digital Content Directive (EU) 2019/770.

7.3 Because BeatLab is explicitly not a medical device and not intended for clinical decision-making (Section 6), AcuteLabs accepts no liability for any clinical decision made using information encountered in the Service.


8. Governing law and disputes

8.1 These Terms (the relationship described in Section 1.1, between you and AcuteLabs) are governed by the laws of the Netherlands.

8.2 If you are a consumer resident in the EU/EEA, this choice of law does not take away the protection given to you by mandatory consumer-protection rules of your own country of residence (Regulation (EC) No 593/2008 "Rome I", Article 6).

8.3 Disputes about your purchase, invoice, VAT or a refund/chargeback are governed by Lemon Squeezy's Buyer Terms (Section 1.3) and should be raised with Lemon Squeezy first.

8.4 Disputes about your use of the Service under these Terms may be brought before the competent court in the Netherlands — Rechtbank Noord-Nederland — without prejudice to your right as an EU consumer to instead bring proceedings in the courts of your own country of residence.

8.5 Alternative dispute resolution. AcuteLabs is not affiliated with a certified alternative dispute resolution body or complaints board. If we cannot resolve a complaint together, you may bring the matter before the competent court named in 8.4. We state this explicitly because you are entitled to know it before you buy.

10. Changes to these Terms

We may update these Terms from time to time, for example when the Service, the law, or our payment provider changes. We will post the updated version here with a new "Last reviewed" date. If a change materially affects your rights, we will email active subscribers before it takes effect.
